In August 2017, Feldman & Pinto’s personal injury and wrongful death lawyers achieved a settlement for plaintiffs in a deadly tree falling case. The claims arose from a tragic incident on June 30, 2012, at Parvin State Park in Pittsgrove Township, New Jersey.
Two minor cousins were killed when a tree fell on them during a “derecho” storm that developed while the boys were camping in the park with their parents. Plaintiffs alleged that defendants State Park Service and New Jersey Department of Environmental Protection created a dangerous condition that resulted in the children’s deaths by:
- failing to properly inspect the tree
- failing to warn of the dangerous condition of the tree and / or the severe weather conditions, and
- failing to evacuate campers to safety
